This document reproduces General Terms and Conditions of the website www.buccelati.com usage (hereinafter “Terms” and the “Website”). Everyone who intend to browse its web-pages, shall follow the Terms.

Buccellati Holding S.p.a. (hereinafter “BHI”) could modify the Terms at any moment, without any previous notice to the users who are obliged to verify periodically the Terms before access the Website.
Accessing the Website after any of this changing, shall be considered full acceptance of it.
In case that in the web-pages are offered goods and services or are presented contents object of particular terms and conditions related in it, these shall prevail on this Terms.
The Website is an Internet portal that provides the users information about Buccellati world; moreover Website purpose is to show a complete review about Buccellati’s major promotional and commercial activities, its products and services and how to enjoy them.
All the Website contents (such as news, photos, videos, sounds, trademarks, domain names, apps, graphical layouts, technical documents and manuals, etc.) and related rights are reserved. They can be visited for personal use only; it is expressly forbidden any other purpose if not previously authorized by BHI.

BHI warns that the Website and its entire content shall not be copied and copied out, reproduced, republished, uploaded, sent and distributed, in any way and form neither entirely nor in part, without the prior and express authorization of Buccellati, except for press activities, downloading and browsing the Website for personal use only and not for commercial ones. However, the material shall not be modified and the indication about the copyrights and the intellectual property rights shall be shown. Moreover, the content shall not be broadcasted, neither in its entirety, nor in part, on the web, television, radio or any other medias, without prior and express authorization coming from BHI.

WARRANTY EXCLUSION AND LIMITED LIABILITY
All the contents uploaded in the Website have general information purpose. BHI doesn’t guarantee on their accuracy and plenitude. BHI saves the rights to modify these information at any time and without any prior notice.
BHI shall not be considered liable for any direct or indirect damages, included loss of profit, that could be occur by using the Website or deriving from the impossibility of browsing it, or using other websites, directly or indirectly linked to it, or by error and omission.
APPLICABLE LAW AND COMPETENT COURT
Except for any different rights according to applicable law –both national and international – these Terms are regulated by Italian legislation and shall be interpreted according to it (except for his conflict of law legislation), included any dispute on Terms existence, validity and effectiveness.
Related to it, the competent court shall be the Court of Milan.
By virtue of application of Italian legislation, in case of potential interpretative contrasts between the Italian version and the English ones of these Terms, shall be applied the Italian ones.

USE OF PERSONAL DATA
PRIVACY – USE OF PERSONAL DATA FOR COMMERCIAL AND MARKETING PURPOSE
This policy (hereinafter “Policy”) is regulated by article 13 D.lgs. 196/2003 – Privacy Code - and is given to whom interact with the BHI on-line services, using the web address www.buccellati.com (hereinafter the “Website”).
The policy is given for the Website only, and not also for other websites linked to it.
Purpose of the personal data use under article 13 D.lgs 196/2013
User’s personal data, freely uploaded on the Website, shall be collected and used in order to:
(a) contact the User who expressly has requested the service, uploading his personal data in this section of the Website, for marketing purposes such as launch of BHI’s products, its sell and assistance network around the world; and/or presentation of third parties who collaborate with BHI; and/or the presentation of the aforementioned activities from parent companies, and/or subsidiaries and/or affiliated companies of BHI. These marketing activity shall be done on the Internet, by phone, by sending email, SMS, MMS, commercial informative and promotional material and advertising material, both from Italy or abroad (also from Extra-EU countries),
(b) send the newsletter/s required by the User;
(c) elaborating statistical and marketing researches.
During their normal function, IT systems and Website software procedure acquire some personal data, normally and implicitly transmitted when you browse on the internet.
Considering their nature itself, these data are not collected to be associated to identified people, but they could permit to identify the Users, if linked to other information belonging to third parties.
These kind of data are: IP addresses, the domain name of the computers used by the User browsing the Website, the URI address (Uniform Resource Identifier) about the research, the time of the web research, the web method used to carry out the research, the response file size, the numerical code sent by the server about the outcome (for example: error 404), and other parameters on User’s operating system and computing environment.
These kind of data are used for research and statistic purposes only about the usage of the Website and for testing its correct operation. They are immediately cancelled after their use.
The data shall be used in order to verify the liability in case of IT crime committed against the Website: except for this event, data are conserved not longer than seven days.
FREELY UPLOADED DATA
In case the User send an email to our email address shown in the Website, he agreed to give us his email address. After receiving an email, we record in our database the sender’s address in order to respond to him. At the same time, potential other personal data included in the email shall be recorded in our database, too.
In our Website we publish dedicated notes referring to particular services which may be requested by the Users.
The Websites uses the so-called “Cookies”. They are simple information recorded by the browse on the User’s hard disk in order to trace his movements on the Website. In this way, anytime the User browse the Website, he could be recognized and his potential preferences, previously shown, could be used. Personal data treatment shall be done through electronic or paper suitable instruments, always regarding the abovementioned purposes and granting data security.
PROVISION OF DATA AND REFUSAL
The user is not obliged to provide his data: anyway, a refusal or incorrect and/or incomplete information, will not permit to BHI to contact in any case the User. In this event, BHI will not be able to send any informative and promotional material, any newsletter, or use them for marketing and statistic research purpose.
BHI collects, communicates and transmits User’s personal data to its sale and assistance network around the world, as well as to third parties collaborating with it, parent companies, subsidiaries and affiliated companies for the purpose mentioned in point 1.
Within BHI different parties could be know User’s personal data, and in particular: BHI company bodies, employees who manage e-commerce, customer care, marketing, IT maintenance and the Reprsentative and the officer who manage the personal data treatment.
User’s personal data shall be communicated to qualified third parties who supply to BHI ancillary services for the purposes mentioned in point 1, included the third parties and companies who participate and/or manage and/or maintenance our Website and IT instrument. In order to reach the purpose mentioned in point 1, BHI shall be exploit the following parties: qualified parties, such as banks, insurance companies, suppliers, subcontractors, who provides to BHI ancillary services for newsletter, promotional communication, marketing and statistic research, event and shows; moreover the abovementioned qualified parties could cooperate with and help BHI regarding legal, fiscal, organizational, social security, accounting aspects; and any other party who BHI shall communicate personal data to, under applicable law.
User’s personal data shall be communicate abroad, under the applicable law, even to Extra EU countries, where BHI seeks its business.
User’s personal data shall not be communicated or promulgated to other parties but the abovementioned.
Regarding to treatment described in point 1., User’s shall practice the rights provided in article 7 D.Lgs. 30th June 2003, n. 196, completely reported below.

A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
A data subject shall have the right to be informed
- of the source of the personal data;
- of the purposes and methods of the processing;
- of the logic applied to the processing, if the latter is carried out with the help of electronic means;
- of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
- of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
A data subject shall have the right to obtain
- updating, rectification or, where interested therein, integration of the data;
- erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
- certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
A data subject shall have the right to object, in whole or in part,
- on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
- to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
The participation to promotional and marketing operations is reserved to voluntary subjects, in accordance to article 7, paragraph 4 lett. b) and to article 130 Privacy Code. In particular for that may concern electronic communication as email, telefax, MMS (Multimedia Messaging Service) or SMS (Short Message Service).
